The engagement of services is when you contact us, schedule or purchase a service offered on our website or otherwise offered to you by Blahaus.
10a. Service Delivery, Scope & Timeframes
All consulting services are provided as fixed-scope offerings and require full upfront payment prior to commencement. Work will commence within a reasonable timeframe following receipt of payment and any required onboarding information.
Estimated delivery for each service is approximately two (2) weeks. This timeframe is an estimate only and is not a guaranteed delivery date. Delivery timeframes may vary depending on factors including, but not limited to, project complexity, scope clarifications, client responsiveness, and availability of required information or materials.
Blahaus will use reasonable endeavours to deliver the services within the estimated timeframe but shall not be liable for delays to the extent permitted by law.
Each service is provided strictly in accordance with the inclusions outlined at the time of purchase or as otherwise agreed in writing. The client acknowledges that:
a. the service is limited to the defined scope of work; and
b. any additional services, revisions, or deliverables outside of that scope will be subject to a separate agreement and may incur additional fees.
Unless otherwise specified, the services include one round of copy revision. Requests that materially alter the original scope, require substantial additional work, or are made after completion of the service may be declined or quoted separately. We are not responsible for delivering outcomes, implementation, or ongoing support beyond what is expressly included in the service scope.
10b. No Guarantee of Outcomes
The client acknowledges that the services involve the provision of professional advice, recommendations, and strategic guidance based on Blahaus' expertise and experience.
While Blahaus will provide the services with due care and skill, we do not guarantee any particular results, outcomes, or level of business performance, as results depend on factors outside Blahaus' control, including implementation, market conditions, and third-party actions.
10c. Consumer Guarantees & Refunds
Due to the nature of consulting services and the allocation of time and resources upon purchase, all fees are non-refundable for change of mind. Once payment has been made, the client commits to the service and no cancellations or refunds will be provided except where required under the Australian Consumer Law.
Nothing in these terms excludes, restricts, or modifies any rights or remedies the client may have under Australian Consumer Law, including guarantees that services will be provided with due care and skill and be reasonably fit for any disclosed purpose.
To the extent permitted by law, Blahaus' liability for a breach of any non-excludable guarantee is limited, at Blahaus' option, to the re-supply of the services or refunding the cost of the service.
10d. Limitation of Liability
To the maximum extent permitted by law, Blahaus' total liability arising out of or in connection with the services, whether in contract, tort (including negligence), equity, or otherwise, is limited to the total fees paid by the client for the relevant services.
Blahaus shall not be liable for any indirect, incidental, special, or consequential loss, including but not limited to loss of profits, loss of revenue, loss of business opportunity, or loss of anticipated savings, to the extent permitted by law. This limitation of liability is subject to any rights the client may have under the Australian Consumer Law that cannot be excluded, restricted, or modified.
10e. Client Responsibilities
The client agrees to provide all information, materials, access, and feedback reasonably required for us to perform the services in a timely manner. We are not responsible for any delay or impact on the services resulting from the client’s failure to do so.
10f. Acceptance of Terms
By purchasing a service, the Client acknowledges that they have read, understood, and agreed to these terms.
